1. INFORMATION FOR THE USER
Who is responsible for processing your personal data?
FORMIN, SA will be responsible for processing the personal data of those individuals who have created a profile on any of its social networks, and such data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR), Organic Law 3/2018 of 5 December (LOPDGDD), and the Law on Information Society Services and Electronic Commerce (LSSI), providing the following information on the processing:


Why do we process your personal data?

Purpose of processing: to maintain a relationship between the USER and FORMIN, SA (hereinafter the DATA CONTROLLER) which may include the following operations:

  • Process requests and inquiries submitted to the data controller
  • Report on activities and events organised by the data controller
  • Provide information about products or services offered by the data controller.
  • Interact via the official profiles


When the DATA CONTROLLER collects and processes personal data via its social media accounts, USERS will be informed of the purpose of the data collection and of their rights in relation to their personal data. Personal data will only be used for the purposes indicated and will be stored securely.


Legal Basis for Processing:
the explicit consent given by the USER for the processing of their personal data for one or more specific purposes (Article 6.1.a GDPR).


Users can also access the social network’s privacy policies at any time and configure their profile to ensure their privacy.


How long will we retain your personal data?

Data retention criteria: data will be retained for as long as the USER does not revoke the consent given, as indicated in this privacy policy.


With whom do we share your personal data?

Communication of data: information provided by the USER via the DATA CONTROLLER’s social networks, including personal data, may be published, depending on the services used by the USER, and may therefore be made publicly available to other third-party users of social networks. From the settings of each social media platform, the USER can configure what information they wish to make public in each case, view the permissions that have been granted, and delete or deactivate them, as with any third-party application that they no longer wish to use.


However, no personal data will be disclosed to third parties outside the social network except, if essential for the development and execution of the purposes of the processing, to our service providers related to communications, with whom the DATA CONTROLLER has signed confidentiality and data processor agreements as required by current privacy regulations.


What are your rights?

Rights of the USER: these may only be exercised in relation to information that is under the control of the DATA CONTROLLER.

  • Right to withdraw consent at any time.
  • Right of access, rectification, portability and deletion of your data, and right to restrict or object to its processing.
  • Right to lodge a complaint with the supervisory authority (www.aepd.es) if you consider that the processing does not comply with current regulations.

2. USE OF THE PROFILE

The DATA CONTROLLER shall perform the following actions:

  • Access to public information on the profile.
  • Publication on the USER’S profile of all information already published on the DATA CONTROLLER’S social network.
  • Send personal and individual messages through social network channels.
  • Page status updates that will be published on the USER’S profile.


The USER can always control their connections, delete content that no longer interests them, and restrict who they share their connections with. To do so, they must access their settings, where they will find various configuration options regarding the privacy level of their user profile on the social network.


3. PUBLICATIONS

The purpose of social media is to give visibility and publicity to the activities carried out by the DATA CONTROLLER. These tools store personal data on the servers of the respective services and are governed by their own privacy policies.


Once the USER has become a follower or has joined the DATA CONTROLLER’s social network, they may post comments, links, images, photographs or any other type of multimedia content supported by the network. In all cases, the USER must be the owner of the content posted, hold the copyright and intellectual property rights, or have the consent of the third parties concerned.


Any publication on social media, whether text, graphics, photographs, videos, etc., that violates or is likely to violate morality, ethics, good taste or decorum, and/or that infringes, violates or breaches intellectual or industrial property rights, image rights or the law, is expressly prohibited. Offensive, defamatory, illegal or inappropriate comments or content will not be tolerated on the company’s profiles. The Company reserves the right to remove such comments or content and block the users responsible.


In such cases, the DATA CONTROLLER reserves the right to remove the content immediately, without prior notice, and may request the permanent blocking of the USER.


The DATA CONTROLLER shall not be liable for any content freely published by the USER.


The USER must bear in mind that their posts will be seen by other users, and therefore they are primarily responsible for their own privacy.


Images that may be published on the social network will not be stored in any file by the DATA CONTROLLER, but will remain on the social network.


4. DATA ON MINORS OR PERSONS WITH SPECIAL NEEDS

It is recommended that you review and read the terms of use and privacy policy of each social network at the time of registration, taking into account the different age requirements for doing so.


Likewise, the DATA CONTROLLER shall be expressly exempt from any liability that may arise from the use of social networks by minors or persons with special needs, whose access should be under the supervision and control of their legal guardians.


The DATA CONTROLLER reserves the right to modify this policy at any time. Changes will be communicated via our social media profiles and/or our website.
